CEDAR CREEK BOARD OF TRUSTEES

The Cedar Creek Board of Trustees met in regular session, at 7:00 p.m., on December 3, 2002,  at the Village Hall. Board members present:  Bode, Muntz,   Rydl, Stauffer.  Absent: Swenson.  Advanced notice of the meeting was given by posting in the Village and by publication in the Plattsmouth Journal.

Motion by Rydl, second by Muntz, to approve the minutes of the 12-03-02 meeting.   All ayes. 

TREASURER'S REPORT:

Account Balances: Checking $29,368.06, Money Market $32,240.89

Motion by Muntz, second by Rydl, to approve the treasure's report and pay all claims.  All ayes.  Board approval given to purchase an extended warranty on the new copier.

POLICE REPORT:

Cass County Deputy reported 68 were logged for Cedar Creek during the month of December.  There were 8 calls for service: Hazard/Obstructions, Parking, Alarm/Undetermined Cause, Welfare Check, Missing Person, 3 Fire/Structure.

CORRESPONDENCE:

Cass County Department of Roads inquiry as to Cedar Creek interest in the previous offer for a joint bidding project.  Dave Rydl will contact Tandy Wilkens and inform him that the village is interested.

JEO review of the proposed one and six year street program.  The public hearing to adopt the one and six year street program will be held at 7:00 p.m. on February 4th.  Legal notice of the hearing will be given.

Notice from D. Heineman of grant funds available for developing a local strategy in support of the Nebraska Homeland Security Strategy.

REPORTS OF OFFICERS, BOARDS, AND COMMITTEES:

G. Stauffer reported, trees are being cut on the river dike in order to apply rip rap to areas approved by the Corps of Engineers.  Plans are being drawn for a 20' x 40' pavilion at the Village Park.  The plans will include a parking area and walk bridge across the drainage ditch.  Cost factor, available grants, and time frame for completion to be determined.  Conversion of the existing shed into a concession stand was discussed.  A meeting of the Tree and Park Boards will be held on January 16th at 7:00 p.m., at the Village Hall.

UNFINISHED BUSINESS:

Street Improvements.  Board members are in agreement that the streets need to be restored and the public should be allowed to have a say in the total project.  Procedures for street improvements were discussed along with deadlines to be met, and the problem of Rural Water cutting streets to connect service and the condition of those streets after the connections are made.  Rural Water District #3 will be requested to repair deteriorating areas which are their responsibility.

Rip rap will be added to the Platte River Dike when tree removal is completed.  The rip rap will be purchased from and hauled by Kerford.  G. Stauffer will notify when ready for the rip rap.

D. Rydl informed the board, there was no new information available on the Clean Community System.

ORDINANCES & RESOLUTIONS:

Ordinance 2003-01 was introduced by Chairperson Bode.  Motion by Stauffer, second by Rydl, to waive the three required readings.  Vote: Bode-yes, Muntz-yes, Rydl-yes, Stauffer-yes, Swenson-absent.  Motion by Rydl, second by Stauffer, to adopt Ordinance 2003-01 amending the Ordinance to include that portion of tax lot 23 which abuts Sunset Drive on the north side of the railroad tracks.  Vote: Bode-yes, Muntz-yes, Rydl-yes, Stauffer-yes, Swenson-absent.

ORDINANCE 2003-01: AN ORDINANCE OF THE VILLAGE OF CEDAR CREEK, NEBRASKA CREATING STREET IMPROVEMENT DISTRICT NO. 2003-1, DEFINING THE SAME AND THE LIMITS THEREOF: PROVIDE FOR PAVING, GRADING, CURBING AND GUTTERING, SIDEWALKS, DRAINAGE AND STORM SEWER OR SUCH OTHER WORK AS NECESSARY AND INCIDENTAL THERETO; PROVIDING FOR PLANS, SPECIFICATIONS, ESTIMATES OF COST AND SECURING BIDS; PROVIDING FOR THE PAYMENT OF SUCH WORK AND OTHER EXPENSES INCIDENTAL THERETO; PROVIDING FOR ASSESSMENT OF THE COST OF SAID IMPROVEMENTS AGAINST THE PROPERTY IN SAID DISTRICT ESPECIALLY BENEFITED THEREBY IN PROPORTION TO SAID BENEFITS; PROVIDING FOR THE INSURANCE OF DISTRICT IMPROVEMENT WARRANTS AND DISTRICT AND INTERSECTION BONDS AND FOR THE LEVY OF SPECIAL ASSESSMENTS AND GENERAL TAXES TO PAY FOR SAID IMPROVEMENTS ; AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM AND THE TIME WHEN THIS ORDINANCE SHALL TAKE EFFECT.

 Ordinance 2003-02 was introduced by Chairperson Bode.  Motion by Muntz, second by Rydl, to waive the three required readings.  Vote: Bode-yes, Muntz-yes, Rydl-yes, Stauffer-yes, Swenson-absent.  Motion by Muntz, second by Stauffer, to adopt Ordinance 2003-02 amending the Ordinance to include Sublots 1 thru 4 of Lot 15 and Sublots 5 and 6 of Lot 16, and Govt Lot 7 abutting Parsons Drive NW 1/4 of the SW 1/4 of section 5-12-12.  Vote: Bode-yes, Muntz-yes, Rydl-yes, Stauffer-yes, Swenson-absent.

MISCELLANEOUS:

One complaint was received of a dog chasing residents.  A letter was sent to the pet owner.  No response and no further complaints.

NEW BUSINESS:

Rick Hightree and Randy Moses of the Cedar Creek Volunteer Fire Department, informed the board of the Fire Department's intent to change the locks on the fire barn due to items missing.  The Trustees approved the changing of the locks and requested one key for the new locks be given to the village clerk.  Due to the change in locks, the board finds it necessary to repair the sidewalk at the front door to allow access in cold weather.

PERMITS:    

Lot #136 Garage   The Planning Commission recommended to deny the permit due to non-compliance of setback regulations.  Motion by Stauffer, second by Rydl, to deny the permit as presented and for the property owner to re-submit if all setbacks and square footage requirements conform.  All ayes.

Motion by Swenson, second by Muntz, to enter into executive session at 8:00 p.m., to discus legal issues.  All ayes.  Motion by Rydl, second by Muntz, to exit executive session at 8:10 p.m.  All ayes.

Chair Bode asked for any comments from those in attendance.  The board was questioned as to the extent of street repairs planned.  It is planned to have 4 inch asphalt overlay on all streets.  The board was also asked when the trees will be cut on the river dike.  G. Stauffer is in charge of the project and not present to answer.

There being no further business to come before the board, motion by  Rydl to adjourn, second by Muntz.   All ayes.
