The Cedar Creek Board of Trustees met at 4:30 p.m. on September 15, 2003, at the Village Hall, for the purpose of holding a Budget Hearing. Advance notice of the Hearing was given by publication in the Plattsmouth Journal and by posting in three public places in the village.
The Hearing was called to order at 4:30 p.m. Roll Call: Bode present, Rydl present, Swenson present, Stauffer absent, Muntz absent. Muntz unable to attend due to work. Board awaited the arrival of Stauffer. Roll call taken at 5:15 p.m. Board members present: Bode, Rydl, Swenson, Stauffer. Absent: Muntz.
Chair Bode called for comments from the public in regard to the proposed budget. No comments were given.
Motion by Stauffer to waive the three required readings of Ordinance 2003-03. Second by Rydl. Vote: Bode yes, Rydl yes, Swenson yes, Stauffer yes, Muntz absent. Motion by Rydl, second by Swenson, to adopt Ordinance 2003-03. Second by Rydl. Vote: Bode yes, Rydl yes, Swenson yes, Stauffer yes, Muntz absent. ORDINANCE 2003-03, AN ORDINANCE TO ADOPT THE BUDGET STATEMENT TO BE TERMED THE ANNUAL APPROPRIATION BILL; TO APPROPRIATE SUMS FOR NECESSARY EXPENSES AND LIABILITIES; TO PROVE FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CHAIRPERSON AND THE VILLAGE BOARD OF TRUSTEES OF THE VILLAGE OF CEDAR CREEK, CASS COUNTY, NEBRASKA: Section 1. That after complying with all procedures required by law, the budget as presented and set forth in the budget statement is hereby approved as the annual appropriation Bill for the fiscal year beginning October 1, 2003 through September 30, 2004. All sums of money contained in the budget statement are hereby appropriated for the necessary expenses and liabilities of the Village of Cedar Creek. A copy of the budget document shall be forwarded, as provided by law, to the Auditor of Public Accounts, State Capital, Lincoln, Nebraska, and to the Cass County Clerk, in Plattsmouth, Nebraska, for use by the Levying Authority. Section 2. This ordinance shall take effect and be in full force from and after its passage , approval, and publication as required by law.
Motion by Rydl, second by Stauffer, to close the Budget Hearing and open the Special Hearing. Vote: Bode yes, Rydl yes, Swenson yes, Stauffer, Muntz absent.
No comments were made by the public relating to setting the final tax request at a different amount than the prior year tax request.
Resolution 915, introduced by Bode, second by Swenson: WHEREAS, Nebraska Revised Statue 77-1601-02 provides that the property request for the prior year shall be the property tax request for the current year for the purposes of the levy set by the County Board of Equalization unless the governing Body of the Village of Cedar Creek passes a majority vote a resolution or ordinance setting the tax request at a different rate or amount and WHEREAS, it is in the best interest of the Village of Cedar Creek that the property tax request for the current year be a different amount than the property tax request for the prior year, to approve the 2 1/2% restricted funds base increase and to exceed the budget by an additional 1% increase; NOW, THEREFORE, the Governing Body of the Village of Cedar Creek, by a majority vote, resolves that: 1. The 2003-2004 property tax request be set at $52,800. 2. The 2003-2004 tax rate be set at .1316. 3. A copy of this resolution be certified and forwarded to the Cass County Clerk prior to October 13, 2003. Vote to approve Resolution 915: Bode yes, Rydl yes, Swenson yes, Stauffer yes, Muntz absent. Time 5:22 p.m.
There being no further business to come before the board, motion by Muntz, second by Rydl, to adjourn. All ayes.
